By becoming a member (or a non-member attending a member event) of The Osher Lifelong Learning Institute at Florida State University (OLLI), I acknowledge and understand that neither Florida State University, nor OLLI is responsible or liable for my welfare while participating in OLLI programs, activities, and clubs, including activities that occur on or off Florida State University’s campuses and/or maintained locations, both domestic and abroad. I do hereby voluntarily consent to my participation in OLLI programs, activities, and clubs, and I assume any and all of the risks arising there from. I knowingly accept all risks and agree to release and hold harmless Florida State University, Florida State University Board of Trustees, Florida Board of Governors, and OLLI, including their employees, agents, representatives, volunteers, assigns and successors, of any responsibility, liability, or cost for any accident or injury of any nature to me arising from my participation, including assuming any costs, including medical costs, as a result of such accident or injury in connection with the activities associated with my participation. I waive any and all claims I may have in the future, including claims of negligence and gross negligence as a result of my participation in OLLI programs, activities, and clubs, and give up and forever release my right to file any lawsuit against Florida State University, Florida State University Board of Trustees, Florida Board of Governors, and OLLI, including their employees, agents, representatives, volunteers, assigns and successors, involving any accident or injury to me resulting from my participation in any OLLI program, activity, or club, including those involved in any travel in which I engage that is related to OLLI programs, activities, and clubs. With regard to travel, I agree to follow all instructions given to me by OLLI and/or Florida State University staff while traveling domestically and/or abroad, and review and abide by all applicable State Department warnings. I further understand and agree that Florida State University, OLLI, and the State of Florida do not provide any indemnification or insurance coverage, such as life, accident, automobile, or health insurance coverage, for OLLI programs, activities, and clubs. As a member of OLLI at FSU (or a non-member attending a member event) I give my permission to 1) take and use without payment, any photographs, slides, or films of myself, as may be needed for public relations purposes, marketing/ advertising, press releases, website development, or training purposes; 2) I further understand that my name and contact information will be distributed to OLLI Instructors and OLLI Leadership in order to conduct classes, programs and activities; and 3) I give my permission to receive emails from OLLI Administration unless I provide written notification to opt out.

GENERAL RELEASE AND WAIVER OF LIABILITY for COVID-19.

The novel coronavirus, COVID-19, which has been declared a worldwide pandemic by the World Health Organization, is extremely contagious and is believed to spread mainly from person-to-person contact. As a result, federal, state, and local governments and federal and state health agencies recommend social distancing and, in some locations, have prohibited or limited the congregation of groups of people. The Osher Lifelong Learning Institute (OLLI) at Florida State University (FSU) and OLLI at FSU, PC30A have put in place preventative measures following federal and state guidelines in an attempt to reduce the spread of COVID-19; however, OLLI cannot guarantee that a member or attendee will not become infected with COVID-19. Further, attending face-to-face OLLI gatherings of classes, club meetings, or activities could increase an individual’s risk of contracting COVID-19.

I have actual knowledge and conscious appreciation of the dangers and risks of COVID-19 and associated with attending face-to-face OLLI gatherings of classes, club meetings, or activities within the circumstances of the current COVID-19 pandemic, including but not limited to illness, injury, hospitalization, medical expenses, disability and death, and do voluntarily consent to my participation in the above-described activities, and specifically assume the risks arising therefrom. Further, I hold harmless and release and forever discharge Florida State University, the Florida State University Board of Trustees, the Osher Lifelong Learning Institution, and their respective officers, officials, employees, agents and successors (collectively, the “Released Parties”), from any and all claims and demands whatsoever, which I or anyone acting on my behalf or represented by or through me, has, had or may have against the Released Parties. This release and waiver is intended to cover all claims by reason of any accident, illness, injury, hospitalization, death, loss, expenses, damage or any other consequences arising or directly or indirectly from any or all of my participation in the above-described OLLI classes, clubs and activities. I understand and agree that this release includes any claims based on the actions, omissions, or negligence of the Released Parties, whether a COVID-19 infection occurs before, during, or after participation in any OLLI class, club, or activity. I fully understand and acknowledge that by agreeing to this release, that I am relying wholly upon my own judgment, belief and knowledge of the circumstances involved in my participation in the above-described class, club or activity and that I have read this statement, understand its contents, and execute it of my own free will and choice with the intent to be legally bound thereby.
